Welcome to Hooked & Trying. The terms “we,” “us,” and “our” refer to Hooked & Trying. These Terms of Service govern your use of hookedandtrying.com and your purchase of products from our store. Our store is hosted by Shopify, which provides the ecommerce platform that allows us to offer our products and services.

By visiting our website or purchasing from us, you agree to these Terms and to our Privacy Policy, Return and Refund Policy, and Shipping Policy. If you do not agree, please do not use the website or place an order.

1. ELIGIBILITY AND ACCOUNTS

You must be at least the age of majority in your state of residence, or have permission from a parent or legal guardian, to use this store. You agree to provide current, complete, and accurate account, billing, payment, and shipping information. You are responsible for safeguarding your account credentials and for activity under your account.

2. PRODUCTS AND MADE-TO-ORDER ITEMS

Items described as “Made especially for you when you order” are produced after your order is placed. These items are subject to the final-sale terms and exceptions described in our Return and Refund Policy.

We work to display product descriptions, measurements, colors, and images accurately. Screen settings, production methods, garment dye processes, and natural variation may cause minor differences in color, placement, texture, or appearance. Product measurements may vary within customary manufacturing tolerances.

We may modify or discontinue products, designs, variants, prices, or availability without notice. We may limit sales by person, household, geographic region, or jurisdiction when reasonably necessary.

3. ORDERS, CHANGES, AND CANCELLATIONS

Submitting an order is an offer to purchase. We may accept, decline, limit, or cancel an order, including for suspected fraud, pricing or listing errors, inventory issues, payment problems, or inability to fulfill the order. If we cancel an order after payment, we will issue the appropriate refund.

Please review product, size, color, quantity, and shipping information carefully before ordering. Requests to change or cancel an order must be submitted to hello@hookedandtrying.com within one hour of purchase. We will make a reasonable effort to help, but changes and cancellations are not guaranteed once production has begun. Orders that have entered production cannot ordinarily be changed or canceled.

4. PRICES, PAYMENT, AND TAXES

Prices and promotions may change without notice. The price charged is the price displayed when the order is submitted, subject to correction of obvious errors. Shipping charges and applicable taxes are displayed during checkout. You represent that you are authorized to use the payment method supplied and agree to pay all charges associated with your order.

5. FULFILLMENT, SHIPPING, AND DELIVERY

Items described as “Made especially for you when you order” are produced after your order is placed and are fulfilled and shipped by our third-party fulfillment partner. Products in one order may be made in different facilities and arrive in separate packages. Processing and delivery dates are estimates, not guarantees. Please review our Shipping Policy for current estimates, tracking, address-error, delayed-package, and lost-package information.

6. RETURNS, REFUNDS, AND ORDER PROBLEMS

Returns, replacements, and refunds are governed by our Return and Refund Policy. Items described as “Made especially for you when you order” are final sale for buyer’s remorse, incorrect size, color, or product selection, and changes of mind. Verified damage, defects, misprints, incorrect items, missing items, and qualifying lost shipments may be eligible for a replacement or refund. Contact us before sending any item back.

7. ORIGINAL ARTWORK AND INTELLECTUAL PROPERTY

The website and its content, including original illustrations, designs, artwork, logos, graphics, photographs, videos, writing, product names, and arrangement, are owned by or licensed to Hooked & Trying and protected by applicable intellectual-property laws. Purchasing a product does not transfer copyright or grant permission to reproduce, trace, copy, modify, distribute, sell, license, or commercially use the artwork.

You may access and use the website for personal, noncommercial shopping purposes. You may not scrape, harvest, reproduce, republish, reverse engineer, or exploit the website or its content; use our artwork to train or develop an artificial-intelligence system; remove ownership notices; impersonate us; introduce malicious code; or use the Services in violation of law or another person’s rights.

8. CUSTOMER CONTENT AND COMMUNICATIONS

If you submit a review, comment, photograph, suggestion, or other content, you represent that you have the right to submit it and that it is lawful and accurate. You retain ownership of your content, but grant us a nonexclusive, worldwide, royalty-free license to use, reproduce, adapt, and display it for operating, improving, and promoting the store, subject to applicable privacy law. We are not obligated to publish customer content and may remove content that is unlawful, misleading, abusive, infringing, or otherwise inappropriate.

9. THIRD-PARTY SERVICES AND LINKS

We use third-party services, including Shopify, payment processors, fulfillment providers, shipping carriers, and analytics or communication providers. Their services may be governed by separate terms and privacy practices. Third-party links are provided for convenience; we do not control and are not responsible for unrelated third-party websites.

10. DISCLAIMER AND LIMITATION OF LIABILITY

To the fullest extent permitted by law, the website and Services are provided “as is” and “as available.” We do not guarantee that access will be uninterrupted, secure, or error-free. Nothing in these Terms excludes warranties, remedies, or rights that cannot lawfully be excluded.

To the fullest extent permitted by law, Hooked & Trying and its service providers will not be liable for indirect, incidental, punitive, special, or consequential damages, lost profits, lost data, or similar losses arising from use of the Services or products. Where liability cannot be excluded, our aggregate liability will not exceed the amount you paid for the product or order giving rise to the claim. Some jurisdictions do not allow certain limitations, so portions of this section may not apply to you.

11. INDEMNIFICATION

To the extent permitted by law, you agree to indemnify and hold harmless Hooked & Trying and its service providers from third-party claims and reasonable costs arising from your unlawful use of the Services, your violation of these Terms, or your infringement of another person’s rights.

12. SEVERABILITY, WAIVER, AND ENTIRE AGREEMENT

If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. These Terms and the policies incorporated by reference form the entire agreement concerning your use of the Services and purchases from the store.

These Terms are governed by the applicable laws of the United States and the state in which Hooked & Trying is headquartered, without regard to conflict-of-law principles, except where consumer-protection law requires otherwise.

We may update these Terms by posting a revised version on this page. Material changes will take effect as required by applicable law. Your continued use of the Services after an update constitutes acceptance of the revised Terms.
